These Terms of Service ("Terms") govern your access to and use of www.purebodynaturals.com and any related sites, content, and services (collectively, the "Site"), and your purchase of products from Pure Body Naturals. The Site is operated by Sendayco, LLC, doing business as Pure Body Naturals ("Pure Body Naturals," "we," "us," or "our").

By accessing the Site or placing an order, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Site or place an order.

1. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to make a purchase. By placing an order you represent that you meet this requirement and that the information you provide is accurate. Minors may use the Site only with the involvement of a parent or legal guardian who agrees to these Terms.

2. Your Account

You may create an account to make ordering easier. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Please notify us promptly at cs@purebodynaturals.com if you believe your account has been used without your authorization. We are not responsible for losses arising from unauthorized use of your account that results from your failure to safeguard your credentials. You agree to provide accurate, current information and to keep it up to date.

3. Products and Information

We sell personal care, beauty, and wellness products. We work to display product descriptions, ingredients, images, and colors as accurately as possible, but we do not warrant that descriptions, colors, or other content are complete, accurate, or error-free, and actual product appearance may vary from your screen.

Important health note. Our products are cosmetic and personal care items. Statements about our products have not been evaluated by the U.S. Food and Drug Administration, and our products are not intended to diagnose, treat, cure, or prevent any disease. Always read labels and ingredient lists, and perform a patch test before first use. If you have a medical condition, allergy, or sensitivity, or are pregnant or nursing, consult a qualified healthcare provider before use. Discontinue use if irritation occurs.

4. Pricing and Availability

All prices are in U.S. dollars and are subject to change at any time before you place an order. Product availability may change, and we may limit or discontinue any product without notice. We make every effort to ensure pricing and product information is accurate, but errors can occur. If a product is listed at an incorrect price or with incorrect information, we reserve the right to cancel or refuse any order placed for that product, even after an order has been confirmed, and to correct the error. If your order is canceled after your payment method has been charged, we will issue a full refund.

5. Orders and Payment

When you place an order, you authorize us (or our payment processor) to charge your selected payment method for the total order amount, including the product price, applicable taxes, and shipping charges. You represent that you are authorized to use the payment method you provide.

Your order is an offer to purchase. We accept your offer, and a binding contract is formed, when we send you an order confirmation or ship your products. We reserve the right to refuse, cancel, or limit the quantity of any order at our discretion, including orders that appear to be placed by resellers or that we suspect are fraudulent or violate these Terms.

If you believe there is a problem with a charge or an order, please contact us first at cs@purebodynaturals.com so we can resolve it quickly. Nothing in these Terms limits any rights you may have under applicable law or your card issuer's policies.

6. Shipping and Delivery

Shipping options, estimated delivery times, and costs are described in our Shipping Policy. Delivery estimates are not guaranteed. Title and risk of loss for products pass to you upon our delivery of the products to the carrier.

7. Returns and Refunds

Returns, exchanges, and refunds are governed by our Return Policy, which is incorporated here by reference. Please review it before placing an order.

8. Promotions and Discount Codes

Discount codes, promotions, and offers are subject to their stated terms, may be modified or withdrawn at any time, cannot be combined unless we say so, have no cash value, and may not be applied to past purchases.

9. Customer Reviews and Submissions

If you submit reviews, photos, comments, or other content to the Site ("Submissions"), you represent that the content is your own, is accurate, and does not infringe anyone's rights or violate any law. Submissions are non-confidential. You retain ownership of your Submissions, but you grant us a royalty-free, perpetual, irrevocable, worldwide, non-exclusive, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display them in any media in connection with our business and marketing. We may, but are not obligated to, monitor, edit, or remove any Submission at our discretion.

10. Acceptable Use

You agree not to use the Site to do anything unlawful, fraudulent, harassing, defamatory, infringing, or otherwise harmful. You agree not to interfere with or disrupt the Site, attempt to gain unauthorized access to any part of the Site or its systems, probe or test its security, introduce malware, scrape or harvest data, or use the Site or its content for commercial purposes without our written permission.

11. Intellectual Property

The Site and its content — including text, images, photographs, graphics, logos, designs, and software — are owned by or licensed to Pure Body Naturals and are protected by intellectual property laws. The Pure Body Naturals name, logos, and trademarks may not be used without our prior written consent. You may view, download, and print Site content for your own personal, non-commercial use only. Any other use, reproduction, or distribution is prohibited without our prior written consent. Requests may be directed to cs@purebodynaturals.com.

12. Third-Party Links

The Site may contain links to third-party websites. We provide these links for convenience only and do not control or endorse those sites, and we are not responsible for their content, products, or practices. Accessing third-party sites is at your own risk and subject to their terms.

13. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that it will be free of viruses or other harmful components. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PURE BODY NATURALS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCTS PURCHASED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS, THE SITE, OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

15. Indemnification

You agree to indemnify, defend, and hold harmless Pure Body Naturals and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

16. Privacy

Your use of the Site and any information you provide are subject to our Privacy Policy, which is incorporated into these Terms.

17. Electronic Communications

By using the Site, you consent to receive communications from us electronically, and you agree that electronic agreements, notices, and other communications satisfy any legal requirement that such communications be in writing. Your electronic submissions constitute your agreement and intent to be bound by the related transactions.

18. Governing Law

These Terms and any dispute arising out of or relating to them, the Site, or your purchases are governed by the laws of the State of Ohio, without regard to its conflict-of-laws rules. Subject to the arbitration provision below, any action that proceeds in court will be brought exclusively in the state or federal courts located in Montgomery County, Ohio (Dayton), and you consent to the personal jurisdiction and venue of those courts.

19. Dispute Resolution; Binding Arbitration

Please read this section carefully — it affects your legal rights.

Except for claims that qualify for small claims court, you and Pure Body Naturals agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your purchases will be resolved by binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration will be conducted before a single arbitrator, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and Pure Body Naturals agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of class proceeding.

30-day right to opt out. You may opt out of this arbitration agreement by sending written notice to cs@purebodynaturals.com or to the address in Section 23 within 30 days of your first purchase or first acceptance of these Terms, stating your name and your intent to opt out. If you opt out, the Governing Law and venue provisions in Section 18 will apply to any dispute.

This section does not prevent either party from seeking injunctive relief in court for intellectual property infringement, and does not waive any rights that cannot be waived under applicable law.

20. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted to the Site with an updated "Last Updated" date. Your continued use of the Site or placement of new orders after changes are posted constitutes acceptance of the revised Terms.

21. Termination

We may suspend or terminate your access to the Site, refuse service, or cancel orders at our discretion if you violate these Terms or for any other lawful reason. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, governing law, and dispute resolution — will survive.

22. General

These Terms, together with the policies incorporated by reference, are the entire agreement between you and Pure Body Naturals regarding the Site and supersede any prior agreements. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely. No agency, partnership, or employment relationship is created by these Terms.
